Approximately two hundred UK women are involved in Essure lawsuits as they seek justice against the manufacturers of the Essure contraception device. These women claim to have suffered physical and psychological anguish due to the device’s implantation. Bayer, a German-based pharmaceutical company, has pledged to defend against these allegations.
Essure, a small metal coil inserted into the fallopian tubes to create a barrier against sperm, was introduced in 2002 as a convenient alternative to surgical sterilisation. However, its withdrawal from the market in 2017 raised questions about its safety.
The legal battle hinges on the assertion by the women’s legal representatives that the Essure coil has inflicted “irreparable damage physically and mentally.” Many report experiencing chronic pain and post-implantation complications, such as heavy bleeding. Some even require hysterectomies or complete device removal.
One of the claimants, Deborah Chalk, shared her harrowing experience. She described how she suffered from numerous health issues, including headaches, abdominal pain, heavy bleeding, rashes, extreme itching, and mood changes stemming from her Essure implant. She only found relief after surgeons removed the device as part of a hysterectomy.
Bayer has emphasised that it prioritises the safety and effectiveness of its products and extends sympathy to anyone facing health issues, irrespective of the cause. The company firmly upholds its safety profile and efficacy and commits to defending itself against the claims.
Bayer highlights that Essure underwent extensive testing, involving ten clinical trials and over seventy real-world observational studies with thousands of women.
While the legal process unfolds, it is essential to remember that the claimants must substantiate the merits of their allegations within the framework of the legal system.
Lisa Lunt, representing the two hundred women and heading the medical-product claims at law firm Pogust Goodhead, expressed hope that Bayer would offer compensation for the pain and suffering experienced by their clients.
Essure lawsuits have gained significant global attention, with Bayer in legal actions related to the Essure device. In the United States (US), the company has already disbursed more than £1.3 billion ($1.6 billion) in settlements for nearly 39,000 women. That’s also without admitting any wrongdoing or liability.
The US Food and Drug Administration (FDA) continues claiming that women who are using the device successfully “should and can continue to do so.
